What is not right in Human Rights Protection? Few reflections on some European Court of Human Rights judgements.
Original language description
While the majority of cases decided by the European Court of Human Rights relates clearly to interference of State authorities to human rights of individuals, a slight minority is often very controversial. In the opinion of the author, the Court should interpret the Convention and decide with respect to over-all conception of human rights protection which reflects human dignity and right development of the society. To promote individual desires of applicants (e.g. desire to have healthy child, desire toadopt child for same-sex couples, desire to have child while using techniques forbidden by national legislation) to their human rights means to overlook an over-all conception of human rights to the future detriment of the society.
