Limitations to the Succession of Liability

  • Original language description

The Article discusses a recent judgement of the Czech Supreme Administrative Court concerning the limitation of period of a single and continuous infringement for which a legal successor of an undertaking may be found liable. According to the Court, if the undertaking seized to exist, the liability may be transferred to its legal successor, in line with the CJ EU's jurisprudence, but only as long as the EU law was a part of the Czech legal order, i. e. after 1 May 2004; before that date, the undertakingcannot be found liable.
