By the end of this year the Damage Directive 2014/104 / EU (the "Directive") will be implemented into Czech law, as well as into national laws of all Member States of the European Union. The new Directive should facilitate claims of infringement of competition law before civil courts. Private enforcement of the competition law is already possible under the current czech legislation, although in practice it occurs very rarely, mainly because of the factual and legal barriers for potential claimants. In the Czech Republic, the situation regarding private enforcement (both in terms of statistics, and in terms of research) is more or less disappointing, as any relevant analysis of existing legal actions was missing so far. The main aim of this article is to summarize and show the development of private enforcement at the European union level, including the evaluation of existing cases that have been discussed before the ECJ and also the evaluation of all cases that have been discussed before Czech courts within the last fifteen years in the field of private enforcement of the competition law, with a special focus on the average duration of each proceedings, the success of the plaintiff in each particular case and on other facts. This article evaluates how was the Czech competition law actually applied in practice within the last fifteen years and highlights a real need of more effective legal regulation.
