    Nature Protection and Conflict of Interests Resolution under the Mining Act

    The chapter discuss an issue of the resolution of conflict of interests between the use of mineral resources (on the one hand) and nature and landscape protection (on the other hand). The protection of nature and the landscape is the typical public interest usually affected by the exploitation of mineral resources. Author analyses relevant provisions of the mining regulations [Act No. 44/1988 Coll., providing for the protection and the use of mineral resources, as amended (&quot;Mining Act&quot;), and the Act No. 61/1988 Coll., regulating mining activities, explosives and the state mining administration, as amended (&quot;Mining Activities Act), as well as the Act No. 114/1992 Coll., providing for nature and the landscape protection, as amended (&quot;Nature and Landscape Protection Act&quot;).
