THE INTERPLAY OF FIELDS OF INTERNATIONAL LAW IN CASE OF FOREIGN INVESTMENTS AFFECTED BY ARMED CONFLICT
Original language description
The topic of protection of foreign investments has been intensively discussed from different perspectives. One of the questions arisen recently is the relationship between the norms of international humanitarian law (IHL), human rights law (IHRL) and international investment law (IIL) in situation of armed conflict. The point is that assets representing foreign investment in the sense of IIL can also represent a civilian or military object in the sense of IHL and private property in the sense of IHRL. Th is paper therefore describes relevant norms of IIL, IHL and IHRL which are typically triggered in armed conflicts (international, including belligerent occupation, and non-international) and then identifies and explains possible contradictions between them in particular scenarios. The paper then introduces a possible methodological model for identifi cation and solution of norms conflicts.
