Original language description
This article examines the term ’cultural genocide’ as defined by Raphael Lemkin through the lens of current legal instruments. It starts by analysing the original concept of crime of genocide as proposed by Lemkin, where the notion of ‘cultural genocide’ had its place and where the general approach was rather holistic. In particular, it focuses on protection of cultural heritage under the concept of cultural genocide and on the approaches possible under the current legal system. First, it explores the legal grounds derived from the framework of human rights, and it analyses the link to cultural rights. It also outlines the cultural heritage that can be protected on such grounds. Second, it examines the possibility of prosecution of acts constituting cultural genocide under International Criminal Law. Should such behaviour be prosecuted under the notion of war crimes, crimes against humanity, or genocide?
