Original language description
The CJ EU interprets the ne bis in idem principle in antitrust cases differently from the manner, in which it employs it in other cases, including the application of the Charter of Fundamental Rights of the EU. This chapter argues that such an approach needs to be changed, in particular because the antitrust-related jurisprudence is also contrary to the case-law of the European Court of Human Rights. It concludes that for the future, the practice of parallel proceedings, i.e. parallel investigation of the same case in different jurisdictions, needs to be abolished.
