Conscientious objection in the Czech Republic
Original language description
The Czech Republic has the conscientious objection enshrined in its constitutional documents, which explicitly regulate the conscientious objection to military service as a fundamental human right. The characteristic of the general conscientious objection as a fundamental right follows from freedom of conscience. At the legal level, only the conscientious objection in medicine is specified, which applies in general to any medical procedure, including abortions, euthanasia, genetic interventions into embryos and the like, both in the case of doctors and non-medical professions. Other types of objections shall be derived from freedom of conscience however, their existence and legitimacy are supported by the case law of the Constitutional Court of the Czech Republic, which accepts both religious and so-called secular conscientious objection. For the Czech Republic as a predominantly atheist state, this guarantee is a very important support for freedom of conscience.
