Problematic aspects of judicial protection against inaction of administrative authorities in the Czech Republic
Original language description
One of the three most important types of comlaints in the Czech administrative judiciary is a complaint for the protection against an inaction of an administrative body. Judicial protection follows on from protection within administrative proceedings (according to the Administrative Procedure Code). Its entrenchment in Czech law in 2002 was a huge positive. Nevertheless, in practice there are some contentious issues or issues for discussion which relate to this complaint. The article analyzes the essence of this complaint, its conditions and hearing in a court. In addition, it focuses mainly on controversial or discussion aspects of its legal regulation and of the case law relating to this complaint. The question is, for example, why this complaint protects only against certain forms of inaction of the public administration. It is also interesting to note that this complaint cannot be sought (with some exceptions) to initiate the administrative proceedings ex officio. The enforceability of the court decisions in practice is also problematic.
