    The calling of witnesses viva voce during the extradition procedure: is it a legal requirement?

  • Original language description

    Extradition between South Africa and other states is principally regulated under the Extradition Act 67 of 1962. In combination with numerous bilateral and multilateral extradition agreements providing for a legal basis for incoming and outgoing extradition requests, the process is well developed and provides for a comprehensive tool at the disposal of the state in transnational combatting of criminal activities. Beyond the domestic and international laws governing extradition procedures, several aspects of extradition have also been clarified and developed by the South African courts. These include, among others, the nature of extradition agreements entered into by South Africa and their incorporation into South African law, the powers of the president to consent to the surrender of an extraditee, and the constitutionality of warrants of arrest issued pursuant to an extradition request.
