Original language description
The ECN+ Directive gives more power to national competition authorities in order to make them more effective enforcers of EU competition law. However, Article 3 of the ECN+ Directive counterbalances this step by requiring that appropriate safeguards are in place to ensure respect for fundamental rights of undertakings in EU competition law enforcement proceedings. The aim of this article is to critically reflect on the requirements of the ECN+ Directive with respect to safeguards for the fundamental rights falling within the ambit of Article 3 of the ECN+ Directive and their implementation by EU Member States. To this end, the article provides first an overview of this provision. Second, the analysis verifies – by bringing together an overview of national laws – whether the very general Article 3 is able to harmonise the safeguards in question. A comparative set of examples from EU Member States, including in particular examples from Poland and the Czech Republic, shows how the way in which Article 3 is formulated invites national legislatures to misuse the potential of this provision. This results in undertakings continuing to face a state of disparity with respect to the level of protection of their fundamental rights in competition law enforcement proceedings between the various national competition authorities.
