The duty of the administrative authority to enable the persons concerned to exercise their rights and legitimate interests.
Original language description
According to the above obligation, the administrative authority must not prevent the persons concerned from exercising their rights and legitimate interests. In accordance with the case law of the administrative courts, such persons may also include associations whose main mission is to protect the environment. The paper aims to define in detail the conditions for the participation of these associations in administrative proceedings, to map the decisions of administrative courts approving the participation of these associations in administrative proceedings, and to address the issue of their active procedural standing in proceedings against the decision of an administrative authority.
