Reform of Private Law in the Czech Republic

  • Original language description

The chapter addresses the fundamental issues of the recodification of private law in the Czech Republic. It describes the reasons for and the course of the recodification, the original concept, and the impact of the recodification on the legal system already during the preparatory phase. Foreign models are clearly identified, as are the problems arising from the use of foreign legislative solutions. A separate chapter is devoted to the reflection of the new regulation in the case law of the ordinary courts. Amendments to the new Civil Code are also not overlooked.
