Original language description
The chapter presents the basic principles on which administrative justice in the Czech Republic is based. These principles are the defining ideas that guided the hand of the legislator in the creation of the Code of Administrative Justice, at the same time they are an interpretive perspective when deciding on particular cases. However, these principles do not exist in a pure form, and as is often the case in law, the Code of Administrative Justice regulates a number of exceptions to these principles. The chapter explains the essence of the basic principles, focusing on the control function of administrative justice, protection of individuals’ public-law rights and cassation principle, but it also deals with specific exceptions to these principles. The author asks herself whether the exceptions do not, in their resulting effects, violate the fundamental concept of administrative justice in the Czech Republic.
