    The Conflict between Foreign Investment Protection and International Climate Commitments: The Case of the Energy Charter Treaty

    This paper provides a doctrinal analysis of the normative dissonance between international investment law and international climate law. It posits that this tension represents a systemic conflict, the practical implications of which are examined through a specific focus on the Energy Charter Treaty (ECT). The theoretical framework distinguishes between vertical conflicts, which manifest themselves as challenges to the sovereign regulatory authority of the state, and horizontal conflicts, which arise from competing international obligations of states. The analysis indicates how the substantive protection provided by the ECT and its investor-state dispute settlement (ISDS) mechanism enables foreign investors to challenge legitimate climate policies, thereby subordinating global climate goals to economic interests. The paper concludes with a systematic summary of the potential solutions, which are divided into three categories-interpretative, reformist and transformative-and argues that a structural reorganisation of the international investment regime is necessary to achieve compliance with the Paris Agreement and its long-term climate goals.
