The EU Anti-coercion Mechanism A Tool for Development or Fragmentation of International Law
Original language description
In a changing geopolitical environment where trade is weaponized as a method of coercion, the EU adopted an anti-coercion instrument (ACI). This chapter perceives the ACI as another avenue through which the EU as a regional international organization contributes to the interpretation or development of international law. ACI was developed as part of the EU’s common commercial policy and enables adopting response measures in reaction to coercion against Member States or the EU. The spectrum of possible measures includes measures otherwise qualified as countermeasures under international law. The instrument brings its own definition of economic coercion. However, it is not settled in international law what forms of economic coercion qualify as prohibited intervention. Moreover, it seems that the EU can adopt anti-coercion measures also when only one or a few Members States are facing coercion. This raises the question of third-party countermeasures. Potential conflict with the WTO dispute settlement raises another legal challenge. The primary goal of this chapter is therefore to contribute to the legal debate on this challenging and multidimensional topic by explaining the main features of the mechanism and pointing to several legal challenges, namely from the perspective of the rules on state responsibility and WTO law.
