Videoconferencing as one of the possibilities for digitising administrative proceedings in the Czech Republic
Original language description
This chapter aims to analyse the possibilities and limits of using videoconferencing in administrative proceedings in the Czech Republic. The basic research question is whether and under what conditions videoconferencing can be considered a procedurally admissible and constitutionally acceptable method of conducting oral proceedings. This question is followed by other sub-questions: how can videoconferencing ensure respect for the principles of immediacy, publicity and equality of participants in proceedings; what guarantees must be provided by law to prevent the procedural rights of participants from being curtailed; and finally, whether, from the point of view of the legal system, it is more appropriate to have a general regulation allowing videoconferencing with the possibility of exceptions laid down by special laws, or, on the contrary, to maintain the current model, where their use is regulated only on a case-by-case basis. The aim of the text is to provide a basis for de lege ferenda considerations on the general incorporation of videoconferencing into Czech administrative law.
