This paper is dealing with the analyses of transparency of public procurement in the field of public administration in the Czech Republic and factors influencing transaction costs and transparency. It is analyses influence o administrative burden and transaction cost on transparency of public contracts. The study is providing towards to the Czech Republic which the one of member state of the European Union. This study and problems with transparency and transaction costs have been demonstrated on the analyses of legal environment and the practice and on sample of contracts awarded by public administration bodies. The public procurement is efficiency when is the balance between transparency (level of competition) and the transaction costs. In this article we concern with some factors of transparency of administrative procedures. According some point of views, there is traditional dominance of formal analysis of tender procedure.
