The purpose of the paper is critical analysis of property rights instrument and their implication in knowledge economics. In the view of institutional economy a property rights pose protection of chosen subjects of market. This type of protection reflects all failures of inefficiency of monopoly competition. The crucial task is the proof of inefficiency in comparison with libertarian conception of economy. Methods used are abduction, comparison, analysis and synthesis.
