When we read the literature dealing with the jurisprudence of the European Court of Human Rights and its practice and argumentation, one particular part of its jurisprudence seems to stand out - the judge-made interpretive principle, the so-called margin of appreciation. The chapter analyses the margin of appreciation in the cases concerning the Prisoner Disenfranchisement saga as a way to highlight a range of issues surrounding the right to vote and, more specifically, the nature and scope of this right in the context of contemporary Europe.n
