CZECH REPUBLIC: brief report on the Czech Foundation Code-A new framework for governance (Business judgement rule in foundation governance)
Original language description
With the aim of designing governance structures for public-benefit foundations, a non-governmental group of stakeholders introduced the Czech Foundation Code in autumn 2024. It serves as a framework for voluntary governance standards in the foundation sector, providing a set of principles and legally non-binding recommendations. It was inspired by the Swiss Foundation Code and developed over 2 years through collaboration between foundation representatives and experts in foundation law and asset management. The governance code draws on the practical experiences, challenges, and ambiguities encountered by Czech foundations and professionals in asset management. These insights aim at assisting new or less experienced foundations and experts in navigating governance complexities effectively.
