V případě klastrů se jedná o zvýšené riziko nekalé kooperace mezi jednotlivými členy, protože soutěžní práv definuje, jaká data a jakým způsobem mohou být sbírána a využívána, resp. jaké riziko zúčastněným subjektům hrozí. Zákon jednoznačně zakazuje například kolektivní sběr takových dat, která se týkají cen, plánovaných objemů prodeje a dalších strategických dat, jejichž využití by mohlo vést k záměrné fixaci cen, objemu produkce, rozdělení, či kontrole trhu.

In the case of clusters it is clear that cooperation is between competitors (rivals in horizontal relationship and suppliers in vertical relationship) and the risk of breaking the competition rule can be very serious. It is strictly forbidden among the other things collectively gather information concerning of prices, planned sales volume and other sensitive or strategic data, which use could lead to direct or indirect fixing the prices, sales volume control, dividing of market etc. There are aspects ofdatasharing in clusters considered in this article.
