The influence of the macroeconomic environment on insolvency of non-enterpreneurs in the Czech Republic in 2008-2013
Original language description
On 1 January 2008, Act No. 182/2006 Coll. on bankruptcy and its settlement methods (the Insolvency Act) took effect and thereby replaced the preceding Act No. 328/1991 Coll. on bankruptcy and settlement. It was thus possible for the very first time to settle the bankruptcy of non-entrepreneurial subjects in a non-liquidating form (if we exclude the ineffective and unused institute of settlement in the previous act). Until that time, over-indebtedness of private persons was settled by bankruptcy, which was markedly demotivating for debtors. Even after the monetization of their property, unpaid debts continued to burden the bankrupt. It is precisely this that the new act endeavours to solve and it has implemented the institute of ?debt-relief?. Simply put, it offers the debtor ? non-entrepreneur the possibility, given the fulfilment of certain conditions, of definitely ridding itself of its debts.
