Anotace anglicky
The project continues the Applicant’s research set out in the volume Czech Parliamentary Culture (2010). Obstructionism as well as other procedural dysfunctions has in the recent years been increasingly present in Czech and other post-communist parliaments. The project’s objectives include: evaluating the influence of the constitutional courts’ case law and rules of procedure on basic functions of parliaments (public debate and adopting legislation); assessing benefits of transplanting principles and rules of parliamentary law from other countries and responding to the following practical problems: How should rules of parliamentary procedure be set within existing constitutional limits as to purposefully promote high-quality parliamentary debate as well as the interest in conducting parliamentary business effectively, allowing the governing majority to enforce its policies through legislation? How should rules of parliamentary procedure be set as to strike a fair balance between quality of legislation and adequate speediness as well as effectiveness of the legislative procedure?
