New Form of System of Alternative Punishments nad Measures in the Czech Republic: Comparison with Selected Foreign Legal Regulations
Project goals
The projectis grounded in the determination of the basis, importance and advantages of measures replacing the unsuspended term of imprisonment, i.e. alternative punishments, alternatives to punishment and procedural alternatives (diversions in criminal proceedings). Its main part will be devoted to complex and detailed analysis of legal regulation of these measures contained in the proposal of the new Criminal Code, in the Criminal Procedure Code (Act. No. 141/1961 Coll.), and in the Juvenile Juridiciary Act (Act. No. 218/2003 Coll.); there will be taken into account also legal regulation as laid down in the current Criminal Code (Act. No. 140/1961 Coll.). the project will further provide an analysis of some foreign legal regulations of alternative measures, focusing particulat on the regulation in Austria, Germany, and Slovakia. Nová podoba systému alternativních trestů a opatření v České republice: srovnání s vybranými zahraničními právními úpravami
Annotation in Czech
Podstatou projektu bude vymezení podstaty, významu a výhod opatření nahrazujících trest odnětí svobody. Projekt tedy bude zaměřen na problematiku alternativních trestů, alternativ k trestu a procesních alternativ, tj. odklonů v trestním řízení. Stěžejníčást bude představovat komplexní a podrobný rozbor právní úpravy těchto opatření, která je obsažena v návrhu nového trestního zákoníku, v současném trestním řádu (zák. č. 141/1961 Sb.) a zákoně o soudnictví ve věcech mládeže (zák. č. 218/2003 Sb.); přihlédnuto bude i ke stávající právní úpravě zakotvené v trestním zákoně (zák. č. 140/1961 Sb.). Projekt se bude dále zabývat rozborem některých zahraničních právních úprav alternativních opatření, a to se zaměřením na úpravu rakouskou, německou a slovenskou. Pozornost bude věnována rovněž činnosti Probační a mediační služby ČR, a to jednak z pohledu právní úpravy a jednak z hlediska metod uplatňovaných při jednotlivých činnostech Probační a mediační služby.
