    Vis Major and Hardship in International Trade: A Study of the CISG, Czech law and Experiences of Czech Exporters

    The paper focuses on the development of regulation and practice when dealing with the negative effects of external changes on contractual performance. The topic is restricted to consideration of Czech law and the CISG regulation in the context of international trade. Regarding the CISG, the text focuses on the development in its interpretation towards the inclusion of hardship situations. Similarly, Czech private law underwent recent developments to cover hardship, but this time made via private law reform which added a new generalrule covering hardship situations. The new Czech rule is analyzed together with the CISG inspired excuse doctrine for the impossibility of performance, with the emphasis on case law regarding sales contracts in each case. In its second half, the study introduces the results of empirical research based on more than twenty qualitative interviews with Czech exporters of goods. The research aimed to map out the experiences of selected Czech exporters over the 2020-2023 time period and considers whether the current Czech law reflects and fulfilstheir needs in practice.
