Czech Republic – National Legal Summary on Remedies Against Online Piracy of Sports Content

  • Original language description

This chapter delves into the legal intricacies surrounding audiovisual sports content within the Czech Republic's legal framework. It begins by dissecting the definitions of "broadcaster" and "sports event organiser" in the context of audiovisual sports content, elucidating their roles and responsibilities. While "broadcaster" is comprehensively defined under both private and public law, encompassing entities transmitting audiovisual content through radio or television, the concept of a "sports event organiser" lacks a specific definition but is closely tied to the "operator" defined in the Support for Sport Act. The chapter further delves into the concept of "sports event broadcast," shedding light on terms used in the Broadcasting Act that remain undefined within the scope of European production promotion, advertising, and product placement obligations. It traces the legal protection of sports events to the CJEU Football Association Premier League Ltd. (FAPL) case, establishing the jurisdiction's stance on copyright protection. While live sports events themselves aren't copyright-protected, event organizers retain authority over audiovisual recordings through contractual obligations. The rights connected to broadcasting, initial rights holders, and related remedies are expounded, emphasizing the exclusive economic rights broadcasters hold over their broadcasts. Specific legal actions against infringement of these rights are highlighted. The chapter also underscores the absence of specific legal protections for sports event broadcasts in Czech law beyond general broadcast protection. It concludes by summarizing the chapter's exploration of the legal landscape surrounding audiovisual sports content in the Czech Republic, offering insights into key definitions, protections, and legal actions available to broadcasters and sports event organizers.
