    Interoperability and Data Access as Effective Remedies in Digital Markets: Internet of Things and Beyond

    While competition has not prevented structural harm from occurring in digital markets, there appears to be an opportunity to avoid similar harm in new segments such as the Internet of Things (IoT). Interoperability and access to data are potentially effective measures to achieve this goal, as they reduce or remove barriers to entry into upstream or downstream markets, thereby preventing consumer lock-in by enabling the entry of competing or complementary services and reducing switching costs, and mitigating disruptive market changes by enabling multihoming. Ex post enforcement of competition law has not been able to introduce effective remedies in the area of interoperability and data access and has also been relatively ineffective in addressing structural harm in digital markets. Ex ante regulation, including in the DMA and Data Act, introduces interoperability and data access obligations that can serve to protect rapidly developing segments such as the IoT.
