The paper deals with the supervision of collective investment schemes and its objective is to define the role of the depositary of collective investment schemes within the scope of capital market supervision. The paper is generally focused on institutions that supervise collective investment schemes (institutional supervision) in particular by checking compliance with laws and regulations in order to ensure the protection of investors interests. The first part of the paper deals with general characteristics of supervision, then the attention is paid to the historical aspects of capital market (i.e. collective investment schemes) supervision in the Czech Republic during the transformation of the Czech economy after 1989. The second part of the paper isfocused on the depositary of collective investment schemes, especially on its role in the contemporary Czech and EU legislation.
