Civil Service Reform in the Czech Republic and Protection of Civil Servants' Rights in Light of European Courts' Case Law
Original language description
Czech Civil Service Act adopted in 2002 has not become effective yet apart from several provisions. A reform of civil service is currently under preparation mainly due to EU strong criticism. New act, or rather a mere amendment to the mentioned Civil Service Act, either of them based on public law regulating method, is expected to be adopted soon. Once the new legislation becomes effective, new rights of civil servants will be protected and a court review of administrative decisions related to recruitment, remuneration, disciplinary and dismissal from service will be granted. The article analyzes recent case law of the European Court of Human Rights and demonstrates on selected recent cases that major tendency in those decisions is extending the scopeof judicial review, and thus granting the right of a fair trial to civil servants.
