European Arrest Warrant: Implications for EU Counterterrorism Efforts
Original language description
This article provides a critical analysis of the introduction and implementation European Arrest Warrant (EAW), with a special focus on its importance for the EU counterterrorism efforts and the future developments in the Justice and Home Affairs (JHA) pillar. Regarding the former, the I argue that despite the initial implementation difficulties, EAW clearly makes the EU legal process of extradition and surrender more legible, efficient and transparent than the previous myriad of extradition conventionsand bilateral agreements among EU Member States. Regarding the latter, I contend that as the hitherto only major practical application of the principle of mutual recognition in the JHA pillar, the lessons from EAW?s implementation offer important insights for the ongoing search for the most appropriate mode of governance in third pillar.
