Conflict between wto legal acts and eu law in case law of the court of justice, with focus on gatt and trips agreements
Original language description
As early as 1972, the European Court of Justice postulated that the provisions of the GATT could not have direct effect as in secondary law. According to the Court, WTO rules do not have direct effect under Community law, even after the change in the nature and spirit of the conventions in the light of the creation of the WTO. Exceptions could be those provisions which give EU citizens rights that they can exercise directly in court. At the same time, it is essential that the EU Community be bound by this international agreement.
