The paper was presented at the professional international seminar “European and International Criminal Law: Human Rights in Criminal Proceedings”, held this year at the University of Maribor in cooperation with the local New University (Nova univerza). The contribution focused generally on the protection of human rights in criminal proceedings, particularly in the context of selected judgments of the European Court of Human Rights (ECtHR). The case presented was V. v. Czech Republic, ECtHR judgment of 7 December 2023, no. 26074/18, which concerned a violation of the right to life of a psychiatric hospital patient following the use of a Taser by the police and administration of medication by hospital staff. After summarizing the factual background, the speakers explained the task aimed at analyzing the judgment and identifying a possible violation of Article 2 of the European Convention on Human Rights. The core focus was an examination of the State’s obligations to protect the lives of individuals placed in psychiatric institutions and the necessity of implementing effective measures to prevent and limit the use of restraint.
