Factoring Companies and Their Regulation

Factoring is an important modern method of enterprise financing. The paper describes regulation of factoring companies in the most important European countries and gives brief information on factoring industry. Most part of the paper describes New BaselCapital Accord, which will be implemented into EC directive by the year 2006. New accord will bring risk evaluation on a more sophisticated basis. Banks will be considered as groups and bank risk will be evaluated on consolidated basis. The paper outlines basic influence of Basel accord on factoring industry. It also considers the importance of factoring companies' supervision and its impact on small and medium enterprise.

Czech description

Faktoring je významná moderní metoda financování podniků. Příspěvek popisuje regulaci faktoringových společností v nejdůležitějších evropských zemích a udává stručné informace o faktoringovém průmyslu. Značná část příspěvku popisuje basilejskou dohodu okapitálové přiměřenosti, která bude implementovaná jako směrnice ES do roku 2006. Nová dohoda umožní evaluaci rizika sofistikovanějším způsobem. Banky budou hodnoceny jako skupiny na konsolidovaném základě. Příspěvek vymezuje hlavní vliv basilejské dohody na faktoringový průmysl. Také stručně uvažuje nad významem dozoru nad faktoringovými společnostmi a jeho dopadem na malé a střední podnikání.
