Actual Issues of National procedural Autonomy and Effective Enforcement of EU Law
Original language description
The judicial system of the European Union strongly influences the development of the EU integration and is one of the moving forces of the process of slow federalisation of the EU. One of its aspects is the impact of the EU law on national procedural rules that insure the enforcement of claims stemming from the EU law. The paper focuses on the recent developments in the case-law of the EU Court of Justice as far as the principles of national procedural autonomy is concerned. It deals with the case C-227/08 Martín that concerned the application of procedural rules in enforcement of consumer rights; the paper deliberates on the division of competences between the EU and Member States in the area of procedural law and the impact of decision of the EU Court of Justice in procedural rules touching the status of private subjects, that is in horizontal relations
