Czech Competition Authority (CCA) gained powers to conduct on-site searches, in principle identical with those of the European Commission, already in 2004. For many years, the CCA&apos;s powers have not been successfully challenged. The first judicial decision finding that the CCA breached the fundamental rights of the parties under investigation came after 10 years of application in 2014. After all the competent Czech courts, including the Regional Court in Brno (RCB), Supreme Administrative Court (SAC) and the Constitutional Court (CC) approved the CCA’s inspection, the European Court of Human Rights (ECtHR) found an infringement. The CCA thus lost its invincibility, but even though the frequency and intensity of judicial review of dawn raids grew, the CCA has been rather successful and even managed to persuade the courts that it possesses powers that were hitherto disputed.By the end of 2025, the CCA nonetheless experienced a serious defeat. The Constitutional Court decided on the illegality of an inspection conducted in 2019, arguing that the evidence gathered by the CCA before the search was insufficient to authorize it. The CC’s decision thus provides an important clarification as to the burden of proof the CCA bears with regard to inspections on business premises.
