Compensation of Injury in the New Civil Code and Compensation for Damage according to the Labour Code
Original language description
The law No. 89/2012 Coll. Civil Code, effective as from 1st January 2014 regulates new conception of liability for obligations from delicts. Under the new Civil Code is used for the harm to property term "damage" and for other harm "non-pecuniary damage". The article deals with the issue compensation of the injury and legal adjustment of the payment of the damage. In the introduction author allocates concept legal responsibility, further gives attention to way, extent and amount of damage. The new regulation brings some of fundamental changes in compensation of bodily injury and killing. Point classification of pain and lesser employability were canceled and the amount theirs compensation will depend on the judicial discretion or on the agreement between the injured and wrongdoer person. Under the Labor Code is maintained of current legal regulation of compensation of damage which is different from Civil Code.
