Biometric data and Liability in Health Applications
Original language description
The health applications evaluate physical and health condition by means of algorithmic assessment. Although the applications are massively used by consumers and doctors, the outcome of these applications need not be always reliable. The reason may be the existence of incomplete data, wrong algorithm or incorrect evaluation of the self-learning algorithm. The incorrect results may lead to damage for health of a user or a patient. The provider of the application is liable for a defective product, nevertheless, the product liability is difficult to prove in practice. Since the health applications process a huge amount of biometric data of second generation relating to health, the provider has to obey the data protection legislation taking into consideration the high risk for data subjects. The violation of the data protection gives rise to the liability for breach thereof. This paper will discuss the liability for damage caused by the health applications in general and the applications used for medical purposes as well as liability for the infringement of fundamental rights caused by the breach of the protection of personal data.
