This paper presents risks with the deposition of the energy by product on the spoil heap. The structure which is located on a spoil heap requires special approach to the solution. Spoil heaps are appreciated for their low permeability. Heterogeneous spoil heaps have mostly unequal deformations, mainly settlement. This phenomenon can damage sealing parts of the deposit of the especially energy by product. The solution of the structure should by supplemented by the mathematical modelling determination of the expect deformation and the settlement. Parameters of soil and deposited materials were examined by means of the back analysis. The discussion proceeds with available stabilizing measures, and concludes with the proposed solutions for renovation
