This article provides guidance on the review of the validity of EU acts in the preliminary reference procedure (Article 267 TFEU), its purpose, scope, and relationship with the review procedure under Article 263 TFEU. It draws on recent CJEU caselaw and opinions of Advocates General to clarify which acts can be reviewed in the preliminary reference procedure and how can the national judges assess whether a particular EU act is invalid.
