Unequal Treatment between Fixed-term Workers and Permanent Workers before the CJEU

  • Original language description

The paper is dedicated to prohibition of discrimination based on fixed-term employment relationship. It analyses clause 4 (1) of the Framework Agreement on Fixed-term Work prohibiting less favourable treatment between workers having employment contract or relationship for fixed term and permanent workers as regards employment conditions. Particular attention is paid to the interpretation of the notion of “employment conditions” in the case-law of the CJEU. Objective grounds justifying different treatment between fixed-term workers and permanent workers are dealt with as well.
