What unifies current law and what fragmentises it from the perspective of legal theory and judicial practice?

The basic research hypothesis of the project is based on the consideration that the purpose of the law that functions as a system is to ensure equality before the law. The fragmentation of law, on the contrary, is due to the attempt to achieve maximum justice in an individual case. Efforts to maintain equality and therefore the generality of the law on the one hand, and the pursuit of an equitable solution in an individual case on the other, are tendencies which are difficult to reconcile. The submitted project aims to identify and analyse systemic as well as anti-systemic elements in current law and to address, on the basis of qualitative analysis, the role of the courts in pursuing unity in the legal system, namely through references to settled case law and the chosen methodology of legal reasoning. The resulting theoretical concept will contribute not only to the solution of practical problems arising from the contemporary fragmentation of the law, but also to the problem of the relationship between public authorities that often compete for the last word when solving hard cases.
