Political Parties and the Constitutional Court of the Czech Republic: Theory and Practice

The transformation of the relationship between political parties and courts, influenced by the rise to power of the populist political parties in multi-party liberal democracies, remain relatively understudied in comparative constitutional law. The proposed project aims to 1) analyse the legal framework and practice of the evolving interactions between political parties and the Constitutional Court of the Czech Republic (CCC) and thereby contribute to latest Law&Politics studies in this field; 2) carry out detailed empirical studies of the abuses of judicial proceedings by the political parties for their political aims and of populist backlashes against the CCC in order to strengthen the resilience of the Czech constitution and contribute to international research on the constitutional resilience; 3) critically assess the political impact of the decision-making of the CCC on the legal issues of major importance for political parties, such as the electoral system or public funding, and to elaborate on constitutional doctrine concerning the role of constitutional courts in democracy.
