Polish-Czech Border Crisis in Light of International law

Anotace anglicky

The aim of the project is to provide a legal analysis on the important political and historical issues between Czech Republic and Poland: the border tensions since 1918. Pivotal question is the status of Cieszyn Sielesia which led Poland and Czechoslovakia to long-lasting turmoil, involving armed hostilities, threat of use of force and annexations. Despite both states being members of the EU community, cross-border tensions are still active. A good example is the dispute concerning the expansion of the Polish Turow Mine near the Czech border. The Turów dispute is a “legacy of Potsdam Agreements” – a change that occurred in 1945 added a new layer of tensions to the overall border dispute in which Poland “inherits” legally and politically the “friction point” located in the tight spot of the border.The study involves differentinternational law fields – mostly law of treaties (treaties and agreements on the border dispute, such as outstanding territorial debt) and use of force (1919 war, annexation of the Transolza in 1938, 1945 crisis and Polish participation in 1968 operation Danube).
