Der Trust ist vor allem Gegenstand der Qualifikation im Rahmen des IPR. Für seine Wirkungen in einheimischer Rechtsordnung des Anerkennungstaates mu? seine Relevanz in der Ursprüngsjurisdiktion beachtet werden, wobei die Anpassung an die relevante Interessen des Anerkennungsstaates mit Vorbehalt durchgeführt werden sollte. Man sollte die einheitliche Anknüpfung vornehmen; denn sie ist eine der Schüsselpunkte des IPR.
