Die Autoren diskutieren in ihrem Beitrag das umstrittene Thema der Verfahrensrechte des Beihilfeempfängers im Rahmen des Verfahrens zur rechtswidrigen Beihilfe vor der Europäischen Kommission. Der Empfänger hat nur Mindestrechte, die nicht seiner tatsächlichen Bedeutung für die Lösung des Problems entsprechen. Die Autoren präsentieren auch einen Vorschlag für eine adäquatere Regelung de lege ferenda.

The authors discuss in their contribution the controversial topic of procedural rights of the state aid beneficiary in the framework of the illegal state aid procedure before the European Commission. The beneficiary has only minimum rights that do not correspond to his actual importance for the solution of the problem. The authors also present a proposal for a more adequate regulation de lege ferenda.
