Comparative European study on restrictions of certain civil and political rights after conviction - Status quo in the Czech Republic

Firstly, the historical background of the criminal sanctions will be outlined. Historically, it was common in the Czech Republic to impose sanctions which aimed primarily at political or civil rights and freedoms, however, this practice was connected with the totalitarian regime. Since the Czech Republic became democratic state governed by the rule of law the above-mentioned sanctions were not introduced to the Criminal Code. The author will present disqualification as a current form of sanctioning; the reason being that it was not clear in the past among scholars to what extend individual activities can be covered by the disqualification. Impact of conviction provided for in the special statutes and the question of the restriction on the voting rights of the imprisoned persons will also be discussed. In conclusion, the author will explain some other forms of restriction of civil and political rights as a consequence of the conviction.
