Der Artikel befasst sich mit den wichtigsten Grundsätzen und Instrumenten der EU-Richtlinie 2009/147 über die Erhaltung wildlebender Vögel, einschließlich der gerichtlichen Rechtsprechung zu dieser Richtlinie. Ferner werden die Rechtsvorschriften über den Schutz von Vögeln im tschechischen Recht, nämlich das Gesetz Nr. 114/1992 Slg., über den Natur- und Landschaftsschutz, mit dem diese Richtlinie umgesetzt wurde, analysiert. Sowohl in der europäischen als auch in der tschechischen Gesetzgebung beobachtet der Autor die Elemente des Schutzes von Vögeln im Rahmen der landwirtschaftlichen Leistung. Abschließend werden die Möglichkeiten geprüft, die Verantwortung landwirtschaftlicher Unternehmer für den Schutz von Vögeln umzusetzen.

The article deals with the main principles and instruments of EU Directive 2009/147 on the conservation of wild birds, including judicial case law on this directive. It further analyses the legislation on the protection of birds in Czech law, namely Law no 114/1992 Coll., on Nature and landscape protection, which transposed this directive. In both European and Czech legislation, the author observes the elements of protection of birds within the framework of agricultural performance. In conclusion, it examines the possibilities of implementing the responsibility of agricultural entrepreneurs in the protection of birds.
