m Jahr 1623 wurde der kaiserliche Feldherr Albrecht von Wallenstein in den Adelsstand des Reichsfürsten von Friedland erhoben. Im darauffolgenden Jahr wurden die von ihm erworbenen Ländereien in Nordwestböhmen offiziell zum Herzogtum Friedland ernannt. Damit begann die kurze Geschichte eines einzigartigen Verfassungsgebildes, das häufig als "Staat im Staat" bezeichnet wird. Die vorliegende Studie unternimmt eine eingehende inhaltliche Analyse der Privilegien, die Wallenstein von Kaiser Ferdinand II. schrittweise verliehen wurden, um die Macht des Friedländer Herrschers zu definieren und zu regeln. Diese Privilegien sind in der Geschichtsschreibung bisher nicht ausreichend berücksichtigt worden. Die Studie identifiziert 14 Urkunden, die für den Rechtsstatus Friedlands relevant sind, und kommt zu dem Schluss, dass das Herzogtum trotz der Befreiung von Verpflichtungen und der durch die Privilegien gewährten Immunität unzweifelhaft ein Teil des Königreichs Böhmen blieb. Faktisch manifestierte sich diese Zugehörigkeit jedoch erst durch das böhmische Steuersystem und das Recht des Herzogs von Friedland, an den Sitzungen des böhmischen Landtags teilzunehmen - eine Möglichkeit, von der Wallenstein nie Gebrauch machte.

n 1623, the imperial commander Albrecht von Wallenstein was ennobled to Reichs-fürstof Friedland. The following year, the estates he had acquired in north-westernBohemia were officially proclaimed the Duchy of Friedland. Thus began the brieften-year history of a unique constitutional formation that has frequently been de-scribed as a "state within the state". This study undertakes an in-depth analysis ofthe contents of the privileges gradually bestowed upon Wallenstein by EmperorFerdinand II to define and regulate the power of the ruler of Friedland. These priv-ileges have hitherto not been paid sufficient attention in historiography. The study identifies 14 documents relevant to the legal status of Friedland andconcludes that despite the dispensation from obligations and the immunity con-ferred by the privileges, the duchy undoubtedly remained a part of the Kingdom ofBohemia. However, this connection became factually manifest only through theBohemian taxation system and the Duke of Friedland's right to participate in the ses-sions of the Bohemian Diet - an opportunity Wallenstein never made use of.
