The Concept of Due Diligence in the Context of Violence Against Scope, Specifics & Critique

The objective of the article is to discuss the concept of due diligence in the context of the protection of women against violence. Through normative and case law analysis, it focuses on the particular scope of this standard and its specifics, offering its distinctive conceptualisation and subsequent critique of its scope. Firstly, the article maps due diligence’s outlines – ranging from the obligation of prevention to obligations to investigate, prosecute, and provide redress for victims – in light of international organisations’ documents, the practice of the CEDAW Committee and regional human rights courts. Secondly, drawing also from her experience with direct work with victims, the author acknowledges that due diligence and its applicability became an integral and crucial tool in the area of protection against violence. At the same time, its specific content and scope might still improve in order to more adequately and safely serve the victims themselves.
